The department runs weekly compliance operations, and in March 2026 Cogta told Parliament it had 29 environmental health practitioners against a need for 98.

In East London the Certificate of Acceptability is issued by the Buffalo City Metropolitan Municipality, through its Municipal Health Services, in the Health, Public Safety and Emergency Services directorate. An environmental health practitioner inspects the premises and recommends the certificate in the name of the person in charge, as Regulation 3 of R638 requires. Whoever issues it, the inspection follows the same regulation. R638 requires the person in charge to be trained (regulation 10(1)(d)) and to keep a record that every food handler has been trained, and the inspector can ask for those records at any visit. Certificates from ASC show the accreditation details and a QR code, so the record is verifiable on the spot.

What is different about East London
- The health authority is Municipal Health Services. Buffalo City Metropolitan Municipality’s Health and Public Safety directorate has two departments, Municipal Health Services and Public Safety; Municipal Health Services holds the environmental health practitioners who inspect food premises and issue the CoA, and it led the spaza closures in North End in 2022 under its general manager (Buffalo City Metro directorate page and statement). The metro’s Health Services By-law, published in 2023, sets minimum health standards for food premises and the transport of food in line with R638 (FEDHASA summary).
- Three towns, one metro. Buffalo City covers East London, Mdantsane, Qonce (King William’s Town), Bhisho, Zwelitsha, Dimbaza and Berlin. The municipality’s enquiry offices sit in the Munifin Centre at Oxford and Caxton Streets in East London, the Civic Centre in Ayliff Street in Qonce, seven zone offices in Mdantsane, and satellite offices in Beacon Bay, Gonubie, Bhisho, Zwelitsha and Dimbaza, which is the network through which a food business finds its EHP (Buffalo City Metro enquiry offices). Phone Municipal Health Services before you travel; the CoA application is a paper form and we have found no published fee or turnaround.
- Weekly clampdown operations. On 8 January 2025 the metro’s Comply Operation in wards 36 and 38 of Qonce inspected six shops, closed four, issued three prohibition notices and condemned stock, and the municipality said the operations roll out weekly across the metro. The checklist it published is a valid business licence, a certificate of acceptability, a fire compliance certificate, an identifiable name outside and the certificates on display (Buffalo City Metro, January 2025).
- The registration numbers. The executive mayor told about 40 foreign shop owners in November 2024 that around 2 000 spaza shops trade in the metro (Buffalo City Metro). By mid-March 2025 only about 10 percent were registered (eNCA). By December 2025 the metro’s database held 1 455 registered shops and about 600 had been closed for non-compliance earlier that year (Daily Dispatch editorial, 4 December 2025).
- Inspector capacity is the constraint. In March 2026 Cogta reported to Parliament that Buffalo City has 29 environmental health practitioners, a shortage of 69, and that no municipality in the country meets the national environmental health norms; across the Eastern Cape 1 406 spaza shops held a CoA out of 9 725 counted (Daily Dispatch, 10 March 2026). A complete file and a training record that scans on the spot are what get a premises through a stretched inspectorate.
- Port, grain and the IDZ. The Port of East London is South Africa’s only remaining river port, with the largest export grain elevator in the country at 76 000 tonnes and a car terminal linked by a dedicated road to the Mercedes-Benz plant (Africa Ports). The East London IDZ agri-industry cluster on the West Bank targets food and beverage manufacturing, poultry, red meat and dairy processing, aquaculture and cold-chain logistics (ELIDZ). Local processors and distributors cluster in Wilsonia, Arcadia, Woodbrook, Fort Jackson and the West Bank.
- Cruise tourism is growing. Buffalo City expected 13 cruise ship calls in the 2025/26 season, up 90 percent on the year before, with close to 3 000 visitors and an estimated R6.8 million for local restaurants, tours and craft markets (Daily Dispatch, 24 November 2025).
- Metro, not province, and the trainer comes from Gqeberha. Buffalo City is a metropolitan municipality, so its own Municipal Health Services deliver municipal health services under section 32 of the National Health Act and the Eastern Cape Department of Health does not inspect food premises inside the metro (DBSA review). Outside it, Amathole District Municipality EHPs cover Butterworth, Stutterheim and Peddie, Chris Hani District covers Komani and OR Tambo District covers Mthatha. Group and on-site training in East London is arranged on request, delivered by an ASC trainer travelling from the Gqeberha head office or live online.

What do Buffalo City’s compliance operations check?
The metro’s published checklist from its January 2025 Comply Operation is a valid business licence, a certificate of acceptability, a fire compliance certificate, an identifiable establishment name outside, and the certificates visible on the premises. On the R638 side the EHP checks structure, hand-wash facilities, temperature control, pest control and the training record for every food handler under regulation 10(1)(d). Non-compliant shops were closed on the spot with prohibition notices.
Will the Buffalo City EHP accept an online ASC certificate?
R638 does not prescribe classroom or online delivery; it requires the person in charge to be trained and a training record for every handler. ASC is a SAATCA registered provider, TC 065, for the R638 Persons in Charge course and a FoodBev SETA accredited provider (587/00337/1900), and every certificate carries a QR code the EHP can scan, which is what a stretched inspectorate of 29 practitioners needs to see quickly.
